Actual Writing provides professional content writing services including blog posts, articles, web content, Shopify SEO optimization, technical writing, and digital marketing content creation. These Terms of Service ("Terms") govern the use of our services and form a legally binding agreement between you ("Client") and Actual Writing ("Company", "we", "us").
By engaging our services, submitting a project request, or making a payment, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.
Each project begins with a detailed scope of work outlining deliverables, timelines, word counts, and specific requirements. The scope serves as the foundation for all project work and any changes must be agreed upon in writing. Project deliverables may include blog posts, web content, SEO optimization, technical documentation, email marketing content, and other content writing services as specified in your project agreement.
We provide up to two rounds of revisions per deliverable to ensure client satisfaction. Additional revisions beyond this limit may incur additional charges. Content is delivered via email or secure file sharing platforms in the format specified in your project agreement.
Payment is required before project commencement unless otherwise agreed in writing. We accept major credit cards, bank transfers, and other payment methods as specified during project setup. All prices are quoted in USD and are subject to applicable taxes.
One-time projects: Full payment required upfront before work begins
Monthly retainers: Payment due on the first of each month for ongoing services
Large projects: 50% upfront, remainder due upon completion and client approval
Overdue payments may be subject to a late fee of 1.5% per month or the maximum amount permitted by law, whichever is less. We reserve the right to suspend services for accounts with outstanding balances until payment is received. Clients remain responsible for all costs of collection, including reasonable attorney fees.
All payments are non-refundable once work has commenced, except as provided in our cancellation policy.
Upon full payment, you will own the rights to all original content created specifically for your project. However, Actual Writing retains the right to use general knowledge, techniques, concepts, and methodologies developed during the project. We also reserve the right to showcase our work in our portfolio and marketing materials unless specifically requested otherwise in writing.
While we strive for accuracy in all content, you are responsible for reviewing and approving all deliverables before publication. We are not liable for any factual inaccuracies that result from information provided by you or from your failure to review and approve content before use.
You warrant that any information, materials, or content you provide to us does not infringe on any third-party rights and that you have the authority to use such materials.
Clients must provide clear project briefs, access to necessary resources, timely feedback, and prompt responses to revision requests. Delays in client communication may result in project timeline extensions without penalty to Actual Writing.
Actual Writing's total liability for any claims related to our services shall not exceed the total amount paid by the client for the specific project in question
We are not liable for indirect, consequential, special, or punitive damages, including but not limited to loss of profits or business opportunities
Our services are provided "as is" without warranty of specific results or outcomes
While we maintain professional standards and strive for excellence, content marketing and SEO results can vary based on numerous factors beyond our control, including market conditions, competition, and client implementation of our recommendations.
Projects may be cancelled by either party with written notice. If you cancel before work begins, you will receive a full refund minus any applicable payment processing fees. Once work has commenced, refunds will be prorated based on work completed to the date of cancellation.
We reserve the right to terminate projects if client communication is unresponsive for more than 30 days or if project requirements fall outside our service scope.
Rush orders requiring completion within 48 hours or during weekends/holidays may incur additional charges of 25-50% of the project cost. Rush order availability is subject to our current workload and team availability.
All rush orders must be agreed upon in writing before work commences.
We maintain strict confidentiality regarding your business information, proprietary data, and project details. All team members sign confidentiality agreements and we use secure systems for file storage and communication. We will not share your information with third parties without your explicit written consent, except where required by law.
We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. For significant changes that affect your rights, we will provide notice via email to existing clients. Your continued use of our services after changes are posted constitutes acceptance of the updated terms.

These Terms of Service are governed by and construed in accordance with applicable laws.
Any disputes arising from these terms or our services will be resolved through binding
arbitration rather than in court, except for small claims disputes under $5,000.
